1. Preamble

The purpose of this document is to inform you of QUANTEAM's policy on the protection of personal data and of your rights with regard to the protection of personal data.

This policy can be consulted on the https://wwwquanteam.fr/ website and is also available on request from dpo@quanteam.fr.

2. Definitions and scope

2.1 Definitions
  • " Entity ": refers to the QUANTEAM entity;
  • " Mission ": means a service agreed between a customer and the QUANTEAM entity to provide assistance to the customer according to the agreed terms;
  • " Candidate ": refers to a person wishing to join QUANTEAM;
  • " Employee ": refers to a person who has joined the QUANTEAM entity, and is still present within the entity;
  • " Ex-employee ": refers to a person who has joined the QUANTEAM entity (or one of the Group entities to which QUANTEAM belongs), but is no longer part of the workforce following the termination of the contract at the initiative of the employee or the entity;
  • " User ": refers to a person, with no connection to one of the entities (neither candidate nor employee), using the website and leaving his/her contact details to be recontacted;
  • " Customer ": means a person who has a direct commercial relationship with the QUANTEAM entity (or one of the entities of the Group to which QUANTEAM belongs);
  • " Prospect ": means a person in commercial contact with the QUANTEAM entity (or one of the entities of the Group to which QUANTEAM belongs);
  • " Partner " means a person who has entered into a commercial, editorial or technological partnership with QUANTEAM (or one of the Group entities of which QUANTEAM is a part);
  • " Subcontractor ": refers to any company that may be required to process Personal Data on behalf of the QUANTEAM entity in accordance with the instructions given by the latter.
2.2 Scope

The Data Protection Policy applies :

  • QUANTEAM employees;
  • Employees and former employees of QUANTEAM (or one of the Group entities to which QUANTEAM belongs);
  • Candidates applying for a position within QUANTEAM (or one of the Group entities to which QUANTEAM belongs);
  • Persons working as subcontractors for QUANTEAM (or one of the Group entities to which QUANTEAM belongs);
  • Customers of the QUANTEAM entity (or one of the Group entities to which QUANTEAM belongs);
  • Prospects of the QUANTEAM entity (or one of the Group entities to which QUANTEAM belongs);
  • Partners of the QUANTEAM entity (or one of the Group entities to which QUANTEAM belongs);
  • Users of QUANTEAM websites.

By giving your explicit consent to this Data Protection Policy, you agree that your personal data may be made available to QUANTEAM and the entities of the Group of which QUANTEAM is a part, in accordance with the terms of this policy.

4. How do we collect your Personal Data?

  • Spontaneous collection :
    On the initiative of a website user who submits his or her CV with a view to being contacted again, or on the initiative of the people in charge of finding candidates to meet a business need. The search is carried out using public social networks. At this stage, the persons identified cannot be considered as candidates, and the public information gathered is not recorded in the company's information system.
  • Collection during a preliminary interview:
    During an application interview, personal data may be collected and recorded in the information system in order to ensure the recruitment follow-up process. The collection will be validated with the candidate beforehand. The applicant will have been informed of his or her rights and remedies in relation to data protection, and of the means of exercising them.
  • Collection at the time of hiring:
    When a contract is signed to join the QUANTEAM entity (or one of the entities of the Group to which QUANTEAM belongs), the personal information required for the administrative or commercial management of the employee will be collected and recorded in the information system. The employee will have been informed of his or her rights and remedies relating to data protection, and of the means of exercising them.
  • Collection at the employee's initiative:
    An employee working for QUANTEAM (or one of the entities of the Group to which QUANTEAM belongs) may complete or modify the content of his or her personal data. The data that can be modified concerns the person's identity, residence, diplomas, languages spoken, skills and CV.
    Secure access (login/password) is required to access this modifiable personal data. Employees are informed of their data protection rights and remedies, and how to exercise them.
    For employees in service on May 25, 2018, whose personal data is recorded in the information system, dedicated information is provided to present the rights and remedies relating to data protection as well as the means of implementing them.
  • Collection at the initiative of the customer or prospect :
    In the context of one of the contact forms on the website in order to contact the QUANTEAM entity (or one of the entities of the Group to which QUANTEAM belongs) or to access premium content, which requires user identification.
  • Collection at the initiative of the partner:
    Within the framework of one of the forms of contact of the Internet site with an aim of contacting the QUANTEAM entity (or one of the entities of the Group to which QUANTEAM is leaned).

5. What information do we collect?

  • Personal Data collected directly from you:
    Among the Personal Data collected directly from you, during an interview, we may collect the following data:
    Surname, first name, maiden name, gender, postal address, nationality, legal information relating to presence in France (residence permit number, date obtained), level of study and diploma, e-mail address, IBAN, number of children, marital status, date and place of birth, social security number, telephone.
  • Personal Data collected indirectly :
    In addition, we may collect Personal Data, indirectly, from sites on which you have made your information available (LinkedIn, Viadeo...). In this case, the data collected would be limited to the data made available.

6. For what purpose(s) do we collect your Data?

The Personal Data we collect directly from you, in particular during recruitment or annual interviews, may be processed for the following purposes:

  • Process 1: Recruitment of new employees:
    Profile search on social networks, interviews to determine technical and functional skills, assessment of interpersonal skills and motivations.
  • Processing 2: Job search :
    Search for customer assignments.
  • Processing no. 3: Employee departure:
    Resignation of an employee, termination procedure.
  • Processing no. 4: Payroll processing:
    Calculation of remuneration and transmission of pay slips.
  • Processing no. 5: Employee career development:
    Monthly committee to review career development wishes.
  • Processing no. 6: Management of employee training needs:
    Monthly committee to examine employees' training needs and requirements.
  • Processing no. 7: Disciplinary interview:
    Interview set up following an employee's misconduct.
  • Processing no. 8: Entity management:
    Production of operational monitoring data for entity management dashboards.
  • Processing no. 9: Meeting legal obligations:
    Transmission of required information to guardianship organizations.

For customers and prospects:
B2B commercial prospecting by telephone or email campaigns, satisfaction surveys, management of internal and external events, exchange of prospect contacts between different Group entities and with partners.

For Partners:
Partner management, exchange of partner contacts with customers and prospects, management of internal and external events.

7. How long is your Personal Data kept?

7.1 Depending on your profile and the type of Personal Data you hold

The retention times are listed below:

Associate and former associate :

  • Personal data: 1 year from end of contract
  • Pay slip: 5 years from end of contract
  • Periodic assessment elements (project sheet, EA): until the employee resigns
  • Disciplinary files, training: right up to the employee's resignation
  • Badging data (for employees concerned): 3 months
  • Telephony data (for employees concerned): 3 months
  • Video surveillance data (for employees concerned): 3 months
  • Documents concerning employment contracts (including amendments): 5 years from end of contract
  • Letter of notification of dismissal: 5 years from end of contract
  • Receipt for final pay: 5 years from end of contract

Candidate :

  • Resume: two years after last contact with explicit consent
  • Cover letter: two years after last contact with explicit consent
  • Record of interview, advice, tests: two years after last contact with explicit consent
  • Personal data: two years after last contact with explicit consent

Customers / prospects :

  • 3 years from collection or last exchange with our customer/prospect

Partners :

  • 3 years from collection or last exchange with partner

8. Who has access to your Personal Data?

The following may have access to your Personal Data:

  • Only certain duly authorized employees based at Group headquarters and assigned to HR, Marketing/Communication, Administration or Sales missions have access to your Personal Data, solely on a need-to-know basis, and they are subject to a strict obligation of confidentiality.
  • The subcontractors or service providers we use for technical services, analytical solutions, etc. ;
  • Our partners in joint marketing/communications/sales initiatives

9. Transfer of your Personal Data

We inform you that your personal data, limited to the "professional experience" dimension, may be transferred to one of the entities of the Group to which QUANTEAM belongs in the context of mission research.
This transfer will be made with the consent of the person concerned.
The entity receiving the personal data is subject to the same Data Protection Policy.

10. Your rights

You have the right to access, rectify, delete, limit and object to the use of your data, as well as the right to define directives concerning the fate of your data in the event of your death, and the right to the portability of your data.

10.2 Supporting documents

Pursuant to the provisions of decree no. 2007-451 of March 25, 2007 amending decree no. 2005-1309 of October 20, 2005 implementing law no. 78-17 of January 6, 1078 on data processing, data files and individual liberties, your request to exercise one of your rights must be accompanied by a photocopy of an identity document bearing the holder's signature. Your request must also specify the address to which the reply should be sent.

We will then have one (1) month following receipt of the request to reply. This period may be extended by two (2) months depending on the complexity and number of requests.

These rights are not absolute: you may exercise them within the legal framework provided and within the limits of these rights. In certain cases, we may not be able to respond favorably to your request (legal obligation, compliance with our commitments to you, etc.). In such cases, we will inform you of the reason(s) for our refusal.

10.3 Right of access, rectification or deletion

As an employee, you can access the Personal Data we have collected directly from you in order to rectify, complete or delete any inaccurate information by :

  • Log on directly to the intranet with your User Account, in the "Employee" section: modify any inaccurate or incomplete information, then save the changes;
  • Contacting us directly at the email and/or postal address(es) indicated above.

You have a right to the deletion of your Personal Data, when :

  • They are no longer necessary for the purposes for which they were collected or processed;

or

  • You have objected to this processing and there are no compelling legitimate grounds for it;

or

  • Personal Data must be deleted in order to comply with a legal obligation, provided for by the legislation of the Union or of the Member States.

As a candidate or user (see definitions paragraph), you may withdraw your consent to the use of your personal data held by one of the Quanteam Group entities without restriction.

10.4 Right to limit processing

You have the right to obtain the limitation of processing when one of the following conditions applies:

  • You dispute the accuracy of the Personal Data;

or

  • The processing is unlawful and you object to the deletion of your Personal Data and request instead that their use be restricted;

or

  • The QUANTEAM entity (or one of the entities of the Group to which QUANTEAM belongs) no longer needs the Personal Data for the purposes of processing, but it is required by you for the establishment, exercise or defence of your rights;

or

  • You have objected to the processing and a check must be made to determine whether the legitimate motives of the QUANTEAM entity (or one of the entities in the Group to which QUANTEAM belongs) outweigh yours.
10.5 Right to the portability of your Personal Data

You have the right to the portability of your Personal Data, i.e. to receive the Personal Data you have provided to us, in a structured, commonly used and machine-readable format, and to transmit it to another data controller.
To exercise your right to the portability of your Personal Data, please contact us using one of the means made available to you in paragraph 10.1 Contact of this policy.

10.6 Right to lodge a complaint with the competent supervisory authority

In the event of difficulties, you have the right to lodge a complaint with the CNIL: https: //www.cnil.fr/fr/plaintes.

10.7 Instructions on what to do with your Personal Data after your death

You have the right to define directives concerning the fate of your Personal Data after your death.
To exercise this right, please send us an e-mail to dpo@quanteam.fr:

  • With the subject " Directives concerning the fate of my Personal Data after my death " ;
  • Indicate the person(s) who can act on our behalf in the event of your death, and the instructions you would like us to follow.

In the event that an employee dies without having left any instructions concerning the fate of his or her Personal Data after his or her death, the employee's heirs may request the deletion of the deceased's data once all the necessary steps have been taken, by contacting us by email at dpo@quanteam.fr.

11. How is your Personal Data secured?

QUANTEAM and the entities of the Group to which QUANTEAM belongs ensure that your data is processed with the utmost security and confidentiality, including when certain operations are carried out by subcontractors or partners. To this end, appropriate technical and organizational measures are in place to prevent the loss, misuse, alteration or deletion of your personal data. These measures are adapted according to the level of sensitivity of the data processed and the level of risk presented by the processing or its implementation.

12. How is your Personal Data secured?

This Personal Data Protection Policy will be reviewed annually and may be amended in the event of significant changes to the regulatory framework or new provisions implemented within QUANTEAM and the entities of the Group to which QUANTEAM belongs.
